Lieutenant General Myint Swe is a member of the Myanmar Armed Forces (Tatmadaw) and was the Tatmadaw-appointed Vice-President until 1 February 2021. On that date, Myint Swe participated in a National Defence and Security Council (NDSC) meeting with other Tatmadaw members. The NDSC meeting was unconstitutional as it did not include its civilian members. During that meeting, Myint Swe was declared Acting President. Myint Swe then declared a state of emergency and handed over legislative, executive and judicial powers of the State to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. The procedure for declaring the state of emergency was breached as, under the Constitution, only the President has the authority to declare a state of emergency. On 31 January 2022, Myint Swe approved the extension of the state of emergency until 31 July 2022. By accepting his nomination as Acting President and by transferring legislative, judicial and executive powers to the Commander-in-Chief, Myint Swe contributed to overthrowing the democratically elected government and is therefore responsible for undermining democracy and the rule of law in Myanmar/Burma.
Le général de corps d’armée Myint Swe est membre des forces armées du Myanmar/de la Birmanie (Tatmadaw) et en a été le vice-président jusqu’au 1er février 2021. À cette date, Myint Swe a participé à une réunion du Conseil national de défense et de sécurité (NDSC), avec d’autres membres de la Tatmadaw. Cette réunion du NDSC était anticonstitutionnelle en ce qu’elle ne comprenait pas ses membres civils. Au cours de cette réunion, Myint Swe a été déclaré président par intérim. Myint Swe a alors proclamé l’état d’urgence et remis les pouvoirs législatif, exécutif et judiciaire de l’État au commandant en chef des services de défense, le généralissime Min Aung Hlaing. La procédure de proclamation de l’état d’urgence n’a pas été respectée puisque, en vertu de la Constitution, seul le président a autorité pour proclamer l’état d’urgence. Le 31 janvier 2022, Myint Swe a approuvé la prorogation de l’état d’urgence jusqu’au 31 juillet 2022. En acceptant d’être nommé président par intérim et en transférant les pouvoirs législatif, judiciaire et exécutif au commandant en chef, Myint Swe a contribué au renversement du gouvernement démocratiquement élu et est donc responsable d’avoir porté atteinte à la démocratie et à l’état de droit au Myanmar/en Birmanie.
