Willy Ngoma

Listed pursuant to paragraphs 7 (c), 7 (e) and 7 (h) of resolution 2293 (2016) as “being political and military leaders of Congolese militias, including those receiving support from outside the DRC, who impede the participation of their combatants in disarmament, demobilization and reintegration processes;” “planning, directing, committing acts in the DRC that constitute human rights violations or abuses or violations of international humanitarian law, as applicable, including those acts involving the targeting of civilians, including killing and maiming, rape and other sexual violence, abduction, forced displacement, and attacks on schools and hospitals;” and “acting on behalf of or at the direction of an entity owned or controlled by a designated individual or entity”, as reaffirmed by paragraph 2 of resolution 2688 (2023). As a leader of M23 (CDe.006), WILLY NGOMA is involved in planning, promulgating and supporting the armed group’s activities.

Owing to his leading position in the M23/ARC, Willy Ngoma is therefore involved in planning, directing or committing acts that constitute serious human rights violations or abuses in the DRC. He is also responsible for sustaining the armed conflict, instability and insecurity in the DRC.

Function or profession: spokesperson of the March 23 Movement/Congolese Revolutionary Army (Mouvement du 23 mars/Armée révolutionnaire du Congo – M23/ARC)

Willy Ngoma holds the leading position of spokesperson of the March 23 Movement/Congolese Revolutionary Army (Mouvement du 23 mars/Armée révolutionnaire du Congo – M23/ARC), a non-governmental armed group operating in the Eastern DRC. The M23/ARC contributes to the armed conflict, instability and insecurity in the DRC, in particular through violence and serious human rights abuses, including killings, attacks and sexual violence against civilians.

Inscrit sur la liste en application des dispositions énoncées aux alinéas c), e) et h) du paragraphe 7 de la résolution 2293 (2016), telles que réaffirmées par le paragraphe 2 de la résolution 2688 (2023), Willy NGOMA s'est livré et continue de se livrer à des actes qui compromettent la paix et la sécurité de la RDC. Dirigeant militaire du M23, il est également le porte-parole de cette milice congolaise, qui reçoit un appui extérieur à la RDC et entrave les processus de désarmement et de réintégration. Willy NGOMA joue donc un rôle majeur dans une entité désignée. Willy NGOMA abuse régulièrement de son pouvoir en tant que dirigeant militaire de l'entité désignée M23 pour compromettre la paix et la sécurité de la RDC. Il est le porte-parole militaire de l'entité désignée M23. En tant que tel, il est en partie responsable des crimes commis par le groupe (meurtres, enlèvements, pillages, recrutement d'enfants soldats, atteintes sexuelles, et commerce, exploitation minière et prélèvements de taxes illicites, et prolifération d'armes) et est directement responsable de la justification et de la promotion des nombreuses attaques perpétrées par le groupe contre des civils dans l'est de la RDC. Son nom figure dans le rapport final de 2023 publié par le Groupe d'experts des Nations unies sur la RDC (voir, entre autres, l'annexe 25, qui porte sur la direction et la structure du M23, et l'annexe 26, qui comporte des informations supplémentaires sur les armes et l'équipement militaire du M23).».
