Minister for Transport and Communications; Member of the State Administration Council

Australian Sanctions Consolidated List,

Admiral Tin Aung San is the Commander-in-Chief of the Myanmar Navy. He has also served as the Minister of Transport and Communications since 3 February 2021. Since 1 February 2023, he is Deputy Prime Minister, and since 3 August 2023, he is Minister of Defence. He is a member of the State Administration Council (SAC). On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander- in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency on 1 February 2021 and transferred the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. On 2 February 2021, the SAC was established to exercise those powers, preventing the democratically elected government from fulfilling its mandate. As a Government Minister of Transport and Communications, he was responsible for communication and networks and thus made decisions and implemented policies that defined the freedom of access to data online. While he occupied this role, there were numerous shutdowns and deliberate slowdowns of the internet, as well as orders for providers to prevent Facebook, Twitter and Instagram from being online. In January 2022, a new draft of the cyber security bill was circulated, which allows for the abuse of surveillance technology in order to monitor and target individuals, and thus to suppress their freedom of expression as well as access to information. He is therefore directly responsible for limiting press freedom and access to information online, as well as for violating the right to privacy of the Myanmar people. In so doing, he has undermined democracy and rule of law in Myanmar/Burma. Being a member of the SAC and Minister of Defence, Tin Aung San has been directly involved in and responsible for decision making concerning state functions and is therefore responsible for undermining democracy and the rule of law in Myanmar/ Burma. He is also directly responsible for the repressive decisions taken by the SAC, including legislation that violates human rights and limits the freedoms of the citizens of Myanmar, and for the serious human rights violations committed by the Myanmar security forces.

L’amiral Tin Aung San est le commandant en chef de la marine du Myanmar/de la Birmanie. Il a également exercé les fonctions de ministre des transports et des communications à partir du 3 février 2021. Depuis le 1er février 2023, il est vice-Premier ministre et, depuis le 3 août 2023, il est ministre de la défense. Il est membre du Conseil d’administration de l’État (SAC). Le 1er février 2021, les forces armées du Myanmar/de la Birmanie (Tatmadaw), dirigées par Min Aung Hlaing, leur commandant en chef, ont perpétré un coup d’État au Myanmar/en Birmanie en rejetant les résultats des élections tenues le 8 novembre 2020 et en renversant le gouvernement démocratiquement élu. Dans le cadre de ce coup d’État, le vice-président Myint Swe, agissant en qualité de président par intérim, a proclamé l’état d’urgence le 1er février 2021 et transféré les pouvoirs législatif, exécutif et judiciaire de l’État au commandant en chef des services de défense, le généralissime Min Aung Hlaing. En sa qualité de ministre des transports et des communications, il était responsable de la communication et des réseaux et, à ce titre, il a pris des décisions et mis en œuvre des politiques définissant la liberté d’accès aux données en ligne. Depuis qu’il a occupé ce rôle, il y a eu beaucoup de coupures et de ralentissements délibérés de l’internet, et ordre a été donné aux fournisseurs d’empêcher l’accès en ligne à Facebook, Twitter et Instagram. En janvier 2022, un nouveau projet de loi sur la cybersécurité a été publié, lequel permet de détourner les technologies de surveillance afin de surveiller et cibler des personnes et, partant, d’entraver leur liberté d’expression et leur accès à l’information. Il est donc directement responsable de la limitation de la liberté de la presse et de l’accès à l’information en ligne, ainsi que de la violation du droit à la vie privée de la population du Myanmar/de la Birmanie. Ce faisant, il a porté atteinte à la démocratie et à l’État de droit au Myanmar/en Birmanie. En tant que membre du SAC et ministre de la défense, Tin Aung San a directement participé à la prise de décisions relatives aux fonctions de l’État et en porte la responsabilité et est donc responsable d’avoir porté atteinte à la démocratie et à l’État de droit au Myanmar/en Birmanie. Il est également directement responsable des décisions répressives prises par le SAC, y compris la législation qui viole les droits de l’homme et limite les libertés des citoyens du Myanmar/de la Birmanie, ainsi que des graves violations des droits de l’homme commises par les forces de sécurité du Myanmar/de la Birmanie.
